Legal framework for the use of Earth remote sensing to ensure national security and defense in the world and in Ukraine

Abstract: The presented study is devoted to the legal analysis of the peculiarities of applying Earth remote sensing for the needs of state defense under the conditions of the armed aggression of the Russian Federation. The paper substantiates that the current legislation of Ukraine does not provide adequate legal regulation of the defense segment of Earth remote sensing, particularly with regard to access to dual-use data, their classification, processing, storage, transmission, and standardization. The absence of clear legal mechanisms complicates the effective use of satellite technologies in the field of national security, intelligence activities, operational planning, and strategic management of defense resources.
Within the framework of this study, the need for harmonization of national rules with international technical and legal standards, including STANAG, as well as the recommendations of the European Space Agency (ESA), has been identified. The expediency of creating a special normative legal act, or a section of a more comprehensive act, regulating the use of Earth remote sensing in the field of national security and defense — taking into account issues of interagency coordination, security, data access, their legal regime, and interoperability — is substantiated. Such a legal act could be either the Law of Ukraine «On Space Activities» or the draft Law of Ukraine «On State Regulation in the Field of Earth Remote Sensing», which is currently under development. Conceptual approaches to improving the relevant national legislation are proposed, including the establishment of an interagency coordination model, the integration of NATO and EU standards, as well as the formation of a unified legal mechanism for the access, processing, and protection of satellite data. The results obtained have both theoretical and practical significance for shaping state policy in the fields of national security, space activities, and technical regulation, further legal regulation of relevant relations, and scientific legal research. |
